MEDICAL
NEGLIGENCE CLAIMS
An
article in the current issue of the Journal of Empirical Legal Studies
(March 2007) examines medical malpractice claims filed against neurologists
and investigates whether they yielded merited outcomes. Lee D. Cranberg,
MD, a neurologist at Cambridge Health Alliance and a Clinical Instructor
in Neurology at Harvard Medical School, and Thomas H. Glick, MD,
Chief of the Division of Neurology at Cambridge Health Alliance
and Professor of Neurology at Harvard Medical School, are the first
and second authors, respectively.
The
authors performed an in-depth review of each of the 42 closed medical
malpractice claims filed in the past 20 years against neurologist
defendants covered by a common insurer. The authors also noted the
case outcome for each. Among their findings is that a significant
portion of claims filed against neurologists were in cases without
negligence.
